By accessing, viewing, or using this repository in any way, you agree to be bound by these Usage Terms. If you do not agree to these terms, you must immediately cease all access and use.

## 1. Definitions

### 1.1 Key Terms

- **"Repository"** - The GitHub repository at https://github.com/barbrickdesign/barbrickdesign.github.io and all its contents
- **"Content"** - All code, documentation, assets, and materials in the Repository
- **"Owner"** - Ryan Barbrick, operating as Barbrick Design
- **"You/User"** - Any person or entity accessing or using the Repository
- **"Commercial Use"** - Any use intended for or directed toward commercial advantage or monetary compensation
- **"Derivative Work"** - Any work based upon the Content, including modifications, translations, or adaptations

## 4. Commercial Licensing

### 4.1 Requirement for Commercial Use

ANY commercial use requires a separate written licensing agreement. Commercial use includes but is not limited to:

- Using Content in commercial products or services
- Incorporating Content into software sold or licensed to others
- Using Content in business operations
- Deriving revenue from Content directly or indirectly
- Using Content in consulting or client work
- Including Content in paid training or educational programs

### 4.2 How to Obtain Commercial License

2. Specific Content you wish to license
3. Intended commercial use case
4. Expected revenue or business model
5. Duration of intended use

### 4.3 License Fees

Commercial licensing fees are negotiated on a case-by-case basis and may include:

- One-time licensing fees
- Recurring royalty payments
- Revenue sharing arrangements
- Combination of upfront and ongoing payments

## 5. Attribution Requirements

### 5.1 When Attribution is Required

If you are granted written permission to use Content, you must provide attribution as specified in your licensing agreement.

### 5.2 Standard Attribution Format

Unless otherwise specified, attribution must include:

## 6. Prohibited Uses

### 6.1 Strictly Prohibited

The following uses are explicitly prohibited without written authorization:

1. **Code Copying** - Copying any source code
2. **Competitive Use** - Using Content to compete with Owner's business
3. **Training Data** - Using Content to train AI/ML models
4. **Plagiarism** - Claiming authorship or ownership
5. **Reverse Engineering** - Decompiling or reverse engineering implementations
6. **Redistribution** - Sharing or distributing Content
7. **Circumvention** - Removing or bypassing security measures or copyright notices
8. **Harmful Use** - Using Content for illegal, harmful, or unethical purposes

### 6.2 Consequences

Violation of prohibited uses will result in:

- Immediate termination of your limited license
- DMCA takedown requests
- Legal action for copyright infringement
- Claims for damages and injunctive relief
- Recovery of attorney fees and costs

## 7. Contributor Terms

### 7.1 Contribution Agreement

By submitting any contribution to the Repository (pull request, issue, suggestion, code, documentation):

1. You grant Owner full and exclusive rights to your contribution
2. Your contribution becomes part of the protected intellectual property
3. You waive any claims to ownership or compensation (unless separately agreed)
4. You affirm your contribution is original or properly licensed
5. You agree to these Usage Terms

### 7.2 Contributor Revenue Sharing

Formal contributors may be offered revenue sharing agreements:

- **Bronze Tier:** 10% revenue share ($50 contribution)
- **Silver Tier:** 12% revenue share ($200 contribution)
- **Gold Tier:** 15% revenue share ($500 contribution)
- **Platinum Tier:** 20% revenue share ($1,500 contribution)

### 7.3 Student Discounts

Students receive 50% off all contribution tiers upon verification.

## 8. Disclaimer of Warranties

### 8.1 "As Is" Basis

THE CONTENT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION

### 8.2 No Guarantee

The Owner makes no guarantee that:

- Content will meet your requirements
- Content will be error-free or secure
- Results from using Content will be accurate or reliable
- Defects will be corrected

## 9. Limitation of Liability

### 9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OWNER SHALL NOT BE LIABLE FOR:

- Any direct, indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or use
- Business interruption
- Cost of substitute goods or services
- Damages arising from your use or inability to use Content

### 9.2 Maximum Liability

In no event shall the Owner's total liability exceed $100 USD.

### 9.3 Essential Purpose

These limitations apply even if the Owner has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any remedy.

## 10. Indemnification

### 10.1 Your Responsibility

You agree to indemnify, defend, and hold harmless the Owner from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

1. Your use of the Repository or Content
2. Your violation of these Usage Terms
3. Your violation of any rights of another party
4. Your unauthorized use of Content

## 11. Term & Termination

### 11.1 Effective Term

These Usage Terms are effective upon your first access to the Repository and continue until terminated.

### 11.2 Termination by Owner

The Owner may terminate your limited license at any time for any reason, including violation of these terms.

### 11.3 Termination by You

You may terminate your license by ceasing all access and use of the Repository.

### 11.4 Effect of Termination

Upon termination:

1. Your right to access and use Content immediately ceases
2. You must destroy all copies of Content in your possession
3. Sections 3, 6, 8, 9, 10, 12, 13, and 14 survive termination

## 12. Governing Law

### 12.1 Jurisdiction

These Usage Terms shall be governed by and construed in accordance with the laws of the United States of America and the state where the Owner resides, without regard to conflict of law principles.

### 12.2 Venue

Any legal action arising from these terms must be brought in the appropriate state or federal courts, and you consent to the jurisdiction of such courts.

### 12.3 Dispute Resolution

Before filing any legal action, parties agree to attempt good faith negotiation to resolve disputes.

### 13.1 Entire Agreement

These Usage Terms, together with the LICENSE and COPYRIGHT files, constitute the entire agreement regarding use of the Repository.

### 13.2 Modifications

The Owner reserves the right to modify these terms at any time. Continued use after modifications constitutes acceptance of the modified terms.

### 13.3 Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

### 13.4 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

### 13.5 Assignment

You may not assign or transfer your rights under these terms. The Owner may assign these terms without restriction.

### 13.6 Headings

Section headings are for convenience only and do not affect interpretation.
